If you are engaged in online sales or just planning to, you have probably heard of  minimal technical conditions, which in certain cases, according to the prescribed law, it is necessary to have. Although it may seem to you that you do not need them and that you can go through without it, we advise you to do everything right because the punishments are enormous.

What are minimal technical conditions?

The minimal technical conditions or a web shop are the conditions that the warehouse must meet in accordance with the prescribed law for the trader to carry out his sales without hindrance and lawfully.

Should online stores have minimal technical conditions?

They need to, but not necessarily all. An online store that trades in wholesale or retail goods must have a warehouse, and therefore an minimal technical conditions. The trader is obliged to provide storage for goods and must submit a request for a decision on meeting the minimum technical requirements and other conditions for performing activities to the locally competent office for lordship affairs of the state administration in the county or the City of Zagreb.

The warehouse must not be in the basement or in the building where you live. The purpose of the space must be business. Also, if you only plan to register the warehouse at the business address and keep the goods in the premises of your home, this will unfortunately not work. The space must meet all minimal technical conditions.

Minimal technical conditions are not required in cases where:

• you already have a retail store and minimal technical conditions for it (use an existing minimal technical conditions);
• produce and distribute only digital content that is not delivered / printed on any of the physical media (CD, DVD, USB, micro-SD, etc.). Since you don’t need a warehouse, you don’t need an minimal technical conditions either;
• for drop shipping, unless it is a matter of manipulation of goods (repackaging) and calculation of prices by the trader. Ordered goods must go straight from the supplier to the customer’s address;
• offer only services over the Internet, not goods;
• use the services of the fulfilment agency for storage and delivery.

Minimum technical and other conditions:

• minimal technical conditions – ensure adequate storage of goods, with a minimum warehouse size of 6m2 (warehouse is not needed if only services are sold);
• if the internet trader uses the warehouse – proof of the right to use and use the business premises, general conditions of construction;
• if online food trade is performed – general sanitary, health and hygienic conditions;
• conditions on the type of goods, method of trade in goods, physic – chemical and other characteristics of goods (according to special regulations).
